1. Agreement to Terms
These Terms of Service form a legal agreement between you and RockSolidHost, Inc. ("RockSolidHost," "we," or "us"). By creating an account, accessing our website, or using any of our hosting services (the "Services"), you agree to these Terms.
If you're using the Services on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.
2. Eligibility & Accounts
You must be at least 18 years old to create an account. You're responsible for everything that happens under your account, including activity by team members or anyone else you grant access to.
Keep your credentials secure and notify us promptly at [email protected] if you discover unauthorized access.
3. Plans, Fees & Billing
Service plans, fees, and billing terms are described at sign-up and on your account dashboard. Subscriptions auto-renew until you cancel. We bill in advance for each billing period.
We may change pricing for new billing periods with at least 30 days' notice. Existing committed terms (such as annual prepaid plans) honor the price you signed up for. Refunds outside our 30-day money-back window are at our discretion.
4. Acceptable Use
Your use of the Services must comply with our Acceptable Use Policy. Violations may result in suspension or termination as described in that policy and in section 8 below.
5. Service Availability & SLA
Our standard SLA targets 99.99% monthly uptime. Service credits are available when we miss it; specific terms (definitions, exclusions, credit calculations) are stated in your order or in the SLA exhibit.
We may schedule maintenance with at least 7 days' notice. Emergency maintenance may occur without notice; we publish updates on our status page.
6. Your Content & Data
You own your content. We don't claim rights to it. You grant us the limited license required to operate, back up, transmit, and display your content as part of providing the Services.
You are responsible for the content you host and for ensuring you have the rights to host it.
7. Intellectual Property
The Services, our trademarks, and our software are owned by RockSolidHost or our licensors. We grant you a non-exclusive, non-transferable license to use the Services according to these Terms.
You may not copy, modify, reverse-engineer, or resell the Services except as expressly permitted (for example, under our partner program).
8. Suspension & Termination
You can cancel at any time from your account dashboard. Cancellation stops auto-renewal; we don't refund partial periods after the 30-day money-back window.
We may suspend or terminate your account for material breach, non-payment after 14 days past due, or if required by law. We'll generally provide notice and a chance to cure, except where harm is immediate — for example, ongoing security incidents or active abuse.
After termination, we retain your data for 30 days so you can export it. After that, we delete it.
9. Disclaimers & Limitation of Liability
The Services are provided "as is" except for warranties we expressly make in these Terms. To the maximum extent allowed by law, our total liability for any claim arising from the Services is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
We are not liable for indirect, incidental, special, or consequential damages, even if we knew they were possible.
10. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and we agree to resolve disputes through binding arbitration in Delaware, except that either party may bring claims in small-claims court or seek injunctive relief in court.
You and we waive any right to a jury trial or to participate in a class action.
11. Changes to These Terms
We may update these Terms. For material changes, we'll notify you by email and update the "Last updated" date at the top. Material changes take effect 30 days after notice; non-material changes take effect immediately.
Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
